The United Nations Development Programme (UNDP) and the UN Working Group on Business and Human
Rights (UNWG) are jointly organizing a private meeting with representatives of Civil Society Organizations
(CSOs) prior to the Inaugural UN South Asia Forum on Business and Human Rights.

Objectives
This meeting aims to provide participants an informal and safe space to:
- Discuss key concerns and challenges regarding business-related human rights abuses in South Asia.
- Exchange good practices and discuss strategies and tools that CSOs have at their disposal to
engage with governments and the private sector.
- Explore steps that CSOs could take to push for the implementation of the UN Guiding Principles
on Business and Human Rights by governments as well as businesses.
- Gain a better understanding of the various engagement opportunities with the UNWG.
- Obtain an overview of the ongoing work of the UNWG.

Context: 
The UN Guiding Principles on Business and Human Rights (UNGPs) were unanimously endorsed by the UN Human Rights Council in June 2011. They have become the global standard for corporate responsibility to respect human rights. At the core of this responsibility is the concept of human rights due diligence (HRDD) as a way for business enterprises to proactively manage potential and actual adverse human rights impacts with which they are involved.
The significant update of the UNGPs by States, businesses and civil society has shifted the debate in the business and human rights field. The UNGPs are being embedded into government policy in an increasing number of countries through national action plans, guidelines (e.g., India’s National Guidelines on Responsible Business Conduct), procurement policies, and legislation (e.g., Modern Slavery Acts of UK and Australia, and French Duty of Vigilance Law). Many companies have started integrating HRDD into their business models, and various initiatives are pushing companies to take their responsibility to respect human rights seriously (e.g., Corporate Human Rights Benchmark). Other international frameworks such as the UN Global Compact, OECD Guidelines for Multinational Enterprises and the ILO Declaration for Multinational Enterprises have been aligned with the UNGPs.HRDD is a key tool for companies not only to discharge their responsibility under the UNGPs, but also to implement the Sustainable Development Goals (SDGs). It is, therefore, critical for businesses to gain a practical understanding of the HRDD process. In the past 10 years, twentyfifty Ltd. has facilitated dialogue and engagements on UNGPs with businesses in Europe and India. It will be our pleasure to facilitate an interactive and engaging session on HRDD process as a side event at the Inaugural UN South Asia Forum on Business and Human Rights in New Delhi. We envisage this session to involve a group of 10-15 business representatives (senior managers).

Objectives: 
  • To demystify the ‘business and human rights’ agenda for businesses operating in India;
  • To facilitate an interactive discussion about the concept and practice of HRDD; and
  • To enable sharing of global and local experiences in conducting HRDD and implementing the UNGPs.

Short description of the session:
The session will be a showing of the film “Breathless” (75 mins), which is a film showing how the asbestos industry moved to take advantages of markets and laws in less developed countries and the struggle of people affected by the industry for redress. It centres on the struggle of victims in Belgium and India, where it takes the director to the largest asbestos waste dump in South Asia. The asbestos story is replicated in many other industries and reflects the difficulties in obtaining remedy in a globalised world.

Session objectives:
To illustrate through the issue of the export of asbestos how corporations have exported the most hazardous and exploitative industries to the less developed world, where people struggle to obtain a remedy, but how through such struggles change can come about. The film is linked to a crowdfunding campaign to fund litigation in India to clean up an asbestos waste dump in Central India (breathlessfund.org), which will hopefully have a wider impact in creating awareness of the hazards of asbestos in India.

Background
In its resolution 17/4 endorsing the UN Guiding Principles on Business and Human Rights (UNGPs), the UN Human Rights Council welcomed “the important role of national human rights institutions established in accordance with the Paris Principles in relation to business and human rights”, and encouraged national human rights institutions (NHRIs) “to further develop their capacity to fulfil that role effectively...”.

NHRIs can contribute to the effective implementation of all the three pillars of the “Protect, Respect and Remedy” framework of the UNGPs. In relation to the “Duty to Protect” pillar, they can assist States to identify whether relevant laws are aligned with their human rights obligations and are being effectively enforced. Concerning the “Responsibility to Respect” pillar, in their role as credible and independent actors, NHRIs can provide guidance to business enterprises and other non-state actors’ on how to address effectively human rights risks and challenges. In connection to the “Access to Remedy” pillar, they can contribute to strengthen accountability and access to remedy for victims of business-related human rights abuse by playing “an essential role in complementing and supplementing judicial mechanisms". The Edinburgh Declaration adopted by the tenth international conference of the International Coordinating Committee of NHRIs also outlines the potential of NHRIs in improving access to effective remedy for business-related human rights abuses. In July 2018, the Human Rights Council requested (A/HRC/RES/38/13) the Working Group “to analyse further the role of national human rights institutions in facilitating access to remedy for business-related human rights abuses, and to convene a two-day global consultation on these issues, open to all stakeholders, and to inform the Council by its forty-fourth session as appropriate”.

Objectives
The session aims to achieve the following objectives:
  • To discuss challenges and opportunities for NHRIs in assisting States to discharge their human rights obligations under international human rights law in relation to business;
  • To discuss the tools NHRIs have at their disposal to support the private sector in discharging their responsibility to respect human rights in line with the UNGPs;
  • To know more about the challenges and limitations NHRIs face in dealing with business-related human rights abuses;
  • To gain a better understanding of the existing mandates, roles and functions of NHRIs concerning accountability and access to remedy for business-related human rights abuses;
  • To exchange best practices of South Asian NHRIs in the field of business and human rights as a peer learning exercise; and
  • To discuss steps that could be taken to strengthen the relationship, collaboration and synergies between the work undertaken by NHRIs in the region, the Working Group and UNDP.

From policy to practice: Corporate responsibility to respect human rights
Background
Unanimously approved by the Human Rights Council in June 2011, the United Nations Guiding Principles on Business and Human Rights (UNGPs) are the authoritative global standard for preventing, mitigating and addressing business-related adverse human rights impacts. Pillar II of the UNGPs, “Corporate Responsibility to Respect”, provides a blueprint for businesses to identify, prevent, mitigate and account for how they address their adverse human rights impacts, including in their supply chains.
The UNGPs have enjoyed widespread uptake and support from states as well as business enterprises. Although several companies have publicly stated their support for the UNGPs and have started taking steps to implement them, they often face multiple challenges in practice, not least because teams in charge of corporate social responsibility or philanthropic activities may be given the responsibility to discharge Pillar II responsibilities. Then there are challenges concerning multi-tier and multi-jurisdictional supply chains and concerns related to the first mover disadvantages.
Against this context, this session will consider a few concrete case studies to understand better how companies could turn the UNGPs from a policy document to an integral part of their business practice.

Onjectives:
This session aims to:
  • Understand how the corporate responsibility to respect human rights under the UNGPs is being operationalised through actions on the part of governments, businesses and other actors such as investors, consumers, trade unions and civil society organisations;
  • Consider how businesses could turn challenges into opportunities in conducting human rights due diligence throughout their business operations;
  • Examine the role of multi-stakeholder coalitions to promote business respect for human rights; and
  • Share good practices and progress made by the private sector in conducting effective human rights due diligence, including by using innovation and technological tools.

Role of courts and national human rights institutions in facilitating access to remedy
Background 
Access to effective remedy is a key component of the UN Guiding Principles on the Business and Human Rights (UNGPs). The UNGPs envisage a role for the following three types of mechanisms to provide remedies for business-related human rights abuses: state-based judicial mechanisms, state-based non-judicial grievance mechanisms (NJMs), and non-state-based grievance mechanisms. While judicial mechanisms are “at the core of ensuring access to remedy”, NJMs, such as national human rights institutions (NHRIs), have “an essential role in complementing and supplementing judicial mechanisms”. Like other NJMs, NHRIs should meet the effectiveness criteria set out in Principle 31 of the UNGPs.

Individuals and communities affected by business activities face several legal, practical and procedural barriers in seeking effective remedies. The OHCHR’s Accountability and Remedy Project has come up with a number of recommendations to overcome these barriers. Moreover, the Working Group on Business and Human Rights (Working Group) has unpacked what an effective remedy means under the UNGPs (A/72/162). In July 2018, the Human Rights Council (A/HRC/38/13) requested the Working Group “to analyse further the role of national human rights institutions in facilitating access to remedy for business-related human rights abuses, and to convene a two-day global consultation on these issues, open to all stakeholders, and to inform the Council by its forty-fourth session as appropriate”.

Human rights due diligence in global supply chains
Background:
The United Nations Guiding Principles on Business and Human Rights provide a globally recognized and authoritative framework that clarifies the respective duties and responsibilities of Governments and companies to prevent, address and remedy adverse human rights impacts linked to business activities.
Human rights due diligence provides a way for enterprises to proactively manage potential and actual adverse human rights impacts with which they are involved, and has become a norm of expected conduct for all business enterprises.
The prevention of adverse impacts on people is the main purpose of human rights due diligence. It concerns risks to people, not risks to business. It should be ongoing, as the risks to human rights may change over time; and be informed by meaningful stakeholder engagement, in particular with affected stakeholders, human rights defenders, trade unions and grassroots organizations. However, human rights due diligence tends to be limited to tier-one companies as managing the risks to and impacts on human rights can be extremely complex in multi-tiered supply chains.
This session aims to discuss different human rights due diligence practices to go beyond tier one as well as to assess the systemic challenges companies face in discharging their human rights responsibilities in the global supply chains.

Objectives:
  •  To assess the importance of human rights due diligence in global supply chains and discuss the gaps and challenges in existing processes and practice;

Labour Standards beyond the factory walls
Background:
Informal economy and the unorganized sector are an integral part of the economy in South Asian countries. With an increasingly interconnected globalised economy, the region has seen a boom in production and manufacturing opportunities in various industries. While this scenario has created opportunities to reduce poverty and generate income, it has also exposed the workers to hazards and exploitation such as child labour, unsatisfactory occupational health and safety conditions, lack of protection for non-payment of wages, retrenchment without notice or compensation, lack of collective bargaining and absence of social security benefits.
There are also workers (e.g., home-based workers, domestic workers and sex workers) who are not generally regarded as part of a typical business. Moreover, there are challenges (e.g., automation, gig economy, climate change) dealt with by the ILO as part the “the future of work” agenda.
The responsibility to respect human rights under the UNGPs applies to all enterprises regardless of their size, sector, operational context, ownership and structure. How could businesses discharge their responsibility to respect all human rights in such a complex world of work with multi-tiered supply chains? How could businesses pay special attention to more vulnerable groups such as migrant workers, persons with disabilities or women, who are often working in most precarious conditions? It is in this background that the session aims to understand the implications of the UNGPs and the ILO standards beyond the factory walls.

Objectives:
This session aims to:
  • Understand the implications of the UNGPs beyond a formal and structured business context;
  • Discuss the role of governments, businesses and other actors to ensure that all human rights of people working in informal/unorganized sector or in gig economy are respected, protected and remedied;
  • Share good practices and initiatives that seeks to implement the UNGPs beyond the factory walls; and
  • Explore tools, strategies and grievance mechanisms available to informal and unorganized labour force in protecting their rights.

Managing adverse impacts of development projects
Background:
According to the UN Guiding Principles on Business and Human Rights (UNGPs), an “adverse human rights impact” occurs when an action, by a business enterprise, removes or reduces the ability of an individual to enjoy his or her human rights. This session will look at the adverse impact of developments projects – including those funded by international financial institutions (IFIs) such as the World Bank, International Financial Corporation, Asia Development Bank, and Asian Infrastructure Investment Bank – on the full range of human rights of individuals and communities. Such large-scale economic and industrial development often impacts disproportionately indigenous peoples and their rights to lands, territories and natural resources.
In many instances, these development projects take place with complete disregard to communities’ right to participate in the control, implementation and the benefits of development and involve little effective consultation (including Free, Prior and Informed Consent in appropriate cases) with the affected communities. By discussing a number of case studies, this session will make a case for a rights-based bottom-up approach to development, in which the human rights of individuals and communities form the core of any development activity.

Objectives:
This session aims to:
  • Enable sharing of experiences of adverse human rights impact by civil society organizations (CSOs);
  • Understand the reasons for reckless development that ignores the human rights of people and the environment;
  • Discuss the role that CSOs can play to encourage businesses and IFIs to conduct effective and comprehensive human rights impact assessment before starting any development project;
  • Explore the role that CSOs can play to hold IFIs and the relevant companies’ accountability for human rights abuses; and
  • Consider how to promote an idea of development that respects rights of impacted individuals and communities and contributes to an inclusive and sustainable development.

Women, business and human rights
Background:
Women experience business-related human rights abuses differently than men and are often affected disproportionately. Businesses do not impact women in isolation: adverse impacts are often a reflection of existing interlocked power equations, intersectional social structures and patriarchal norms. Women all over the world continue to face discrimination in multiple forms at various level and experience additional barriers in seeking access to effective remedies for business-related human rights abuses.
Despite major advancement made in achieving gender equality in political, economic, social and cultural spheres, women continue to face significant challenges in career development or in striking a work-family balance. From discrimination in recruitment and promotion to gender pay gap and sexual harassment at workplace, women continue to face these challenges in both public and private sectors. Although many women achieve lower and middle management positions, they seem to hit the ‘glass ceiling’ in many organizations and are under-represented in corporate boards and rarely given the top management positions. Women, who are over-represented in informal economy and in supply chains of certain sectors, are especially vulnerable to exploitation. Many women work on agriculture land but do not own it and consequently, face disadvantage in accessing bank loans or getting compensation for land acquisition. Women continue to experience ‘double burden’ and often bear the brunt of gender-segregated industries. While various technological tools are empowering women, the discrimination and harassment against women extends to social media platforms. Women human rights defenders are exposed to gender-based violence in addition to the risks faced by any human rights defender.
It is, therefore, critical that both states and business enterprises consider these unique experiences of women and the structural discrimination or barriers that they face in seeking remedies. To assist states and businesses in integrating a gender perspective in implementing the UN Guiding Principles on Business and Human Rights UNGPs, the UN Working Group will be providing concrete guidance as part of its June 2019 report to the Human Rights Council. This session aims to:
  • Understand better the nature of differentiated and disproportionate impact of businessactiviies on women;
  • Unpack the positive as well as negative impact ofbusiness oerations on women in different sectors ans settings;
  • Discuss what gender-sensitive measures businesses can take to overcome structural discriminations faced by women in South Asia while implementing the UNGPs and the SDGs: and
  • Share best practices concerning the role of business in promoting substantive gender equality in both public and private spheres.
